News Release – Minister Kenney introduces sponsorship restriction to address marriage fraud

Toronto, March 2, 2012 — The Government of Canada has put in place a bar on sponsorship in an ongoing effort to deter people from using a marriage of convenience to come to Canada, Citizenship, Immigration and Multiculturalism Minister Jason Kenney announced today.

Regulatory changes now in force mean sponsored spouses or partners will have to wait five years from the day they are granted permanent residence status in Canada to sponsor a new spouse or partner. Until now, a sponsored spouse or partner arriving in Canada as a permanent resident could leave their sponsor and sponsor another spouse or partner themselves, while their original sponsor was still financially responsible for them for up to three years.

“I held town hall meetings across the country to hear from victims of marriage fraud,” said Minister Kenney. “In addition to the heartbreak and pain that came from being lied to and deceived, these people were angry. They felt they had been used as a way to get to Canada. We’re taking action because immigration to Canada should not be built upon deceit.”

Minister Kenney was joined by representatives of Canadians Against Immigration Fraud (CAIF) at today’s announcement.

"We welcome the steps taken by the Honourable Jason Kenney to stop marriage fraud,” said Sam S. Benet, President of CAIF. “These measures will definitely protect the integrity of our immigration system.”

Spousal sponsorship is open to abuse when a person enters into a relationship – such as a marriage or a common law partnership – in order to circumvent Canada’s immigration law. Concerned with the problem, the Minister held online consultations in the fall of 2010 to gather public opinion and ideas on how to best address marriage fraud.

“Many of the people who took part in the consultations made it abundantly clear that marriage fraud poses a significant threat to our immigration system,” added Minister Kenney. “Our government has listened to the victims of marriage fraud and all Canadians, and acted to crack down on those who engage in fraud and abuse Canadians’ generosity and our immigration system.”

Barring such sponsorships is consistent with similar restrictions imposed by Australia, New Zealand and the United States.

The proposal for a five-year sponsorship bar was prepublished in the Canada Gazette on April 2, 2011, and was open for a 30-day public comment period. The changes coming into force today, March 2, are posted on Citizenship and Immigration Canada’s website and will be published in Part II of the Canada Gazette on March 14, 2012.

To show it is serious about cracking down on marriage fraud, CIC is taking a number of steps to deter it. For example, in addition to the sponsorship bar, further public consultations are also expected to begin in the coming weeks on a proposed conditional permanent residence measure. A Notice of Intent proposing the development of this conditional measure was published in the Canada Gazette on March 26, 2011. The measure aims to deter people in newer relationships from using their relationship to gain quick entry to Canada as permanent residents when they have no intention of staying with their sponsor.

long term skill shortage list




Some occupations have been axed while some have been added to the skills shortage list.

This has been done keeping in view the changing requirements of the economy and the workers of New Zealand.

Changed Long Term Skill Shortage List—The new Long Term Skills Shortage List of New Zealand immigration has been announced by the Department of Labor of New Zealand.

Among the lists reviewed by New Zealand immigration include Canterbury Skill Shortage List, Immediate Skill Shortage List and Long Term Skill Shortage List.

<blockquote>The Long Term Skills List(LTSL) now includes agricultural science jobs. Meanwhile, numerous teaching occupations no longer find place in the revised New Zealand immigration’s Long Term Skills List. </blockquote)

New occupations added in LTSL include—
•    Biotechnologist (Genetics Scientist)
•    Environmental Research Scientist(Water Quality Analyst)
•    Social Professional nec(Applied Social Scientist)
•    Life Scientist nec(Animal Scientist or Bioinformatics)
•    Agricultural Scientist(Farm Systems Scientist)

Occupations axed from the revised ISSL(Immediate Skill Shortage List) are—

•    Early Childhood Teacher
•    Primary School Teacher
•    Early Childhood Teacher(Montessori)
•    Secondary School Teacher

New Zealand is experiencing acute shortage of skills in specific categories and such vacancies will need to be filled by inviting immigrant workers, said general manager of the Labor and Immigration Research Center, Vasantha Krishnan.

Immigrants getting jobs in New Zealand in any of the occupations will be provided New Zealand work visas.

By adding new occupations and removing certain occupations from the skills shortage list of New Zealand immigration will help in providing employers of New Zealand with workers having requisite skills needed to fill jobs in New Zealand.

The policy of New Zealand labor and immigration department is to undertaken periodical reviews of its skill shortage lists to make sure these lists are not only flexible but in tune with the changing requirements of the economy of the nation, admitted Krishnan.

Applicants desirous of immigrating to New Zealand under the New Zealand Skilled Migrant Category must gain a minimum of one hundred points. A point worth notable is that nearly 50-60 points are granted for having an offer of job in New Zealand or any existing job requiring management, technical or specialist expertise.

New rules for FSW


CIC NOT ACCEPTING FEDERAL SKILLED WORKER APPLICATIONS UNTIL JANUARY 2013; MORATORIUM ON INVESTOR AND ENTREPRENEUR APPLICATIONS CONTINUES




Today, Thursday, June 28, 2012, Citizenship, Immigration and Multiculturalism Minister Jason Kenney made a major announcement in a speech he gave to the C.D. Howe Institute in Calgary, Alberta, Canada.

Prior to today’s announcement, Citizenship and Immigration Canada had indicated that if a new General Occupations (Demand) List for the Federal Skilled Worker Class was not released on July 1, 2012 (as had been promised), the quotas for jobs on the existing General Occupations (Demand) List would reset to zero. Instead of releasing a new List and/or resetting the quotas, Minister Kenney today announced that Citizenship and Immigration Canada will place a temporary pause on new Federal Skilled Worker Applications as well as new Investor Applications and would continue the moratorium on new Entrepreneur Applications.

According to the Minister, the pause will allow Citizenship and Immigration Canada to make what it considers to be important changes to its economic immigration programs before accepting more Applications.

Application intake for the Federal Skilled Worker Class is expected to resume in January 2013, when proposed Federal Skilled Worker Class regulatory changes are expected to come into force. Those changes will be announced in the coming months. The pause does NOT apply to individuals with Arranged Employment or those wishing to apply under the PhD stream of the Federal Skilled Worker Class. Those Applications will continue to be accepted.

As for new Investor and Entrepreneur Applications, a moratorium will remain in place until further notice.

What does this mean

If you are an existing client of Abrams & Krochak who has not yet applied for Permanent Residence and were expecting to have your Federal Skilled Worker, Investor or Entrepreneur Application filed on or after July 1, 2012, your Application will likely not be filed until January 2013, assuming you meet the new selection criteria that will be set out in regulatory changes.

If you are not yet a client of Abrams & Krochak but wish to become one and you have received a favourable eligibility assessment from the firm,  your Application for Permanent Residence cannot be filed until January 2013 at the earliest, and on the assumption that your eligibility to immigrate is not adversely affected by regulatory changes. In the event that your eligibility to immigrate IS adversely affected, Abrams & Krochak will work with you to explore other options to make your proposed Canadian Immigration plans a success (i.e. Arranged Employment/Provincial Nominee Programs/ Temporary Visas (i.e. Work Permits/Study Permits), etc.).

With all of the changes taking place with respect to Canada’s Immigration system and all of the uncertainty that these changes have caused, one thing is certain: Now more than ever it is wise to have legal representation to help you understand and navigate the complex Canadian Immigration Application process.

CHANGES ANNOUNCED TO FEDERAL SKILLED WORKER AND CANADIAN EXPERIENCE CLASSES; CREATION OF NEW FEDERAL SKILLED TRADES CLASS

On Friday, August 17, 2012, Citizenship, Immigration and Multiculturalism Minister Jason Kenney announced proposed regulatory changes to the Federal Skilled Worker Class and Canadian Experience Class as well as the creation of the Federal Skilled Trades Class. All of these changes will take effect on January 1, 2013.
FEDERAL SKILLED WORKER CLASS
Among the changes announced by the Minister are:
Increasing the importance of language by establishing new minimum official language thresholds and increasing the points awarded for “Language” from 24 to 28 points;
Increasing the emphasis on younger immigrants by increasing the points awarded for “Age” from 10-12 points and awarding maximum points to applicants between the ages of 18-35;
Increasing the points awarded for Canadian work experience and reducing the points awarded for foreign work experience from 21 to 15 points;
Simplifying the arranged employment process; and
Awarding points for spousal language ability and Canadian experience.
Another change announced by the Minister is the creation of the “Educational Credential Assessment”. As of January 2013, all Federal Skilled Worker Class applicants will have to have their education abroad assessed against Canadian education standards by designated organizations chosen by Citizenship and Immigration Canada (CIC). CIC will then award points according to how an applicant’s foreign educational credential compares to a completed educational credential in Canada.

FEDERAL SKILLED TRADES CLASS
Also announced by the Minister was the creation of the Federal Skilled Trades Class to facilitate the immigration of certain skilled tradespersons in Canada, in response to labour market needs. The Class would be open to skilled tradespersons with experience in the following occupational areas: Industrial, Electrical and Construction Trades; Maintenance and Equipment Operation Trades; Supervisors and Technical Occupations in Natural Resources, Agriculture and Related Production; Processing, Manufacturing and Utilities Supervisors and Central Control Operators; as well as Chefs and Cooks, and Bakers and Butchers.

Applicants to the proposed program would be required to meet four (4) minimum requirements:
1. A qualifying offer of employment from up to two (2) employers in Canada of at least one (1) year duration or a Certificate of Qualification from a provincial or territorial Apprenticeship Authority;
2. Language proficiency, as evidenced by a test from a designated language testing organization that demonstrates the applicant’s abilities in the requisite skill areas meet the threshold set by the Minister in all four (4) language abilities (speaking, reading, writing, oral comprehension);
3. Twenty-four (24) months of work experience (after qualification/certification in the country where the work was performed, where applicable) in the same skilled trade in the last five (5) years; and
4. Qualifications that satisfy employment requirements as described by the National Occupational Classification, except for certification and licensing requirements, which are difficult to obtain outside Canada.

CANADIAN EXPERIENCE CLASS
The Minister announced that the Canadian work experience requirement will be reduced from twenty-four (24) months to twelve (12) in the preceding thirty-six (36) months. Only applicants with managerial/professional/technical/skilled trade work experience would continue to qualify for the Canadian Experience Class (CEC).
Furthermore, just as will be the case with the Federal Skilled Worker Class, a minimum language threshold will be required in each of the four (4) abilities for applicants to the CEC. Initially, it is anticipated that the threshold would be set at “moderate intermediate proficiency” in speaking, oral comprehension, reading and writing for applicants with managerial/professional/technical work experience and “low intermediate” proficiency in each ability for applicants with skilled trade work experience.

WHAT DOES THIS MEAN?
If you are an existing Federal Skilled Worker Class client of Abrams & Krochak who has not yet applied for Permanent Residence, your qualifications will be subject to the revised points grid/selection criteria and you will have to have your foreign educational credentials assessed. Likewise, if you are a skilled tradesperson, you might qualify in the new Federal Skilled Trades Class.

Immigration minister to give criteria for denying entry to Canada

Jason Kenney to table details of bill that would give more power to immigration minister




OTTAWA — Immigration Minister Jason Kenney plans to seek advice from all parties on how to “strike the right balance” between barring foreigners whose views could inspire violence and those who simply espouse unpopular political opinions.

Kenney promised to put forward a list of criteria aimed at clarifying a clause in Bill C-43, the government’s Faster Removal of Foreign Criminals Act, that gives the minister the new power of “negative discretion.”

It allows the minister to bar foreigners on the basis of “public policy considerations,” but the government has come under fire for failing to explain just what that means.

“The idea of this power of negative discretion in Bill C-43 would be to give us an extraordinary power in very exceptional cases to deny admission,” he said Tuesday following a speech on border security in London, England.

“We’re not looking at some broad, generalized power to prevent the admission of people to Canada whose political opinions we disagree with but rather those whose hateful attitudes, if given expression in Canada, could potentially lead to hateful actions or violence.”

Kenney promised to engage members of an all-party Commons committee on the issue when it begins reviewing the bill next week.

“I’m, quite frankly, going to ask all the members from all the parties at the immigration committee to give me their best advice on how to strike the right balance,” he said.

The NDP had one piece of early advice for Kenney Tuesday: Get it right the first time.

Immigration critic Jinny Sims argued Kenney has a “habit” of introducing legislation and other policy changes, only to alter them when he faces criticism. It happened after the government introduced its Protecting Canada’s Immigration Act and again after the Conservatives came under fire for cutting certain refugee health-care provisions.

“We’ve been pointing out that that part of C-43 was wide open,” she said. “To say that you’re going to keep people out for public policy reasons, that’s such a wide net and the fact that the power is invested in the minister is even more of a concern because it leaves it open for political manipulation.”

She’s prepared to take a look at the amendments he puts forward and is hopeful that the changes will include taking the discretion out of the hands of politicians.

It’s expected the new law could be used to justify barring people like controversial U.S. pastor Terry Jones who was stopped at the border last week under dubious circumstances.

Scheduled to speak at a conference in Canada, Jones was denied entry based on an old criminal conviction in Germany, though many believe it’s his promotion of International Burn a Qur’an Day that really raised eyebrows.

Kenney is set to wrap up a nearly two-week trip to Ireland, Hungary and the U.K.

While in England to talk about Canada’s efforts to beef up the border, Kenney said he was also invited to meet with members of the Conservative Party at 10 Downing Street. They apparently wanted to know more about his success boosting political support among newcomers and ethnic communities.

“Obviously the Conservative Party of Canada has a partnership and certain links with other parties of the centre right in democratic countries,” he said.

“I was happy to share our experience and our ideas on it.”

He suggested Conservative values like personal responsibility, reducing taxes and fighting crime resonate with newcomers and that polls suggest 42 per cent of non-Canadian born voters chose his party in the last election. “It was our honest approach, based on values and principles, that have succeeded to a certain degree,” he said.
